Terms of Service — HalalCrypto

Important: By accessing or using HalalCrypto (halalcrypto.exchange), you agree to be bound by these Terms of Service. If you do not agree, please discontinue use immediately. These terms contain a limitation of liability and a binding arbitration clause.

1. Service Description

HalalCrypto ("we," "us," "our," "the Platform") operates the website located at halalcrypto.exchange and related subdomains. We provide the following educational and informational tools:

Halal Coin Screener: A database of cryptocurrencies classified as halal, doubtful, or haram based on our proprietary Shariah screening methodology.
Market Data Tools: Real-time and historical market data sourced from the Binance public API, presented for educational purposes.
Zakat Calculator: An estimate tool for calculating potential zakat obligations on cryptocurrency holdings.
Whale Activity Monitor: On-chain transaction data aggregated and displayed for informational purposes.
Trading Signals: Pattern-based alerts generated by automated analysis, provided as educational content only — not investment advice.
Educational Content: Blog posts, guides, newsletters, and learning resources on halal finance and cryptocurrency.
API Access: Programmatic access to our screening database for qualifying subscribers.

HalalCrypto is operated as a sole proprietorship. The Platform is intended for users aged 18 and over who are seeking educational resources on the intersection of Islamic finance principles and cryptocurrency markets.

2. Not Financial Advice

Nothing on HalalCrypto constitutes financial advice, investment advice, trading advice, or any other type of advice. We are not registered as an investment adviser, broker-dealer, financial planner, or any regulated financial professional in any jurisdiction.

All content on the Platform — including halal classifications, market data, trading signals, whale alerts, price predictions, and Zakat estimates — is provided solely for educational and informational purposes. You should not construe any content on this Platform as a recommendation to buy, sell, hold, or otherwise transact in any cryptocurrency or other financial instrument.

Before making any financial decision, you should consult with a qualified, licensed financial adviser who is aware of your individual circumstances, risk tolerance, financial situation, and investment objectives.

Similarly, nothing on this Platform constitutes a fatwa or binding Islamic legal ruling. For binding religious guidance on the permissibility of any financial transaction, consult a qualified Islamic scholar (mufti).

3. No Guarantee of Accuracy

The Platform retrieves market data from the Binance API and other third-party sources. While we make reasonable efforts to display accurate information, we make no warranty, express or implied, regarding the accuracy, completeness, timeliness, or reliability of any data, price, classification, or other information displayed on the Platform.

Market data may be delayed, incomplete, or incorrect due to API failures, network issues, or third-party data errors.
Halal classifications reflect our research at a point in time and may not reflect the latest scholarly opinions, protocol changes, or business activity of a given project.
Zakat calculations are algorithmic estimates and may not account for all fiqh positions on cryptocurrency valuation.
Trading signals are generated by automated systems and carry no guarantee of profitability or accuracy.

You acknowledge that reliance on any information provided by the Platform is at your sole discretion and risk.

4. User Assumes All Risk

Cryptocurrency trading and investment carries extreme risk. You may lose your entire invested capital. Past performance of any cryptocurrency is not indicative of future results.

By using the Platform, you expressly acknowledge and agree that:

You assume full responsibility for all decisions made based on information obtained from the Platform.
Cryptocurrency markets are highly volatile, unregulated in many jurisdictions, and subject to manipulation, hacking, and total loss of value.
A halal classification does not imply that a cryptocurrency is a sound, safe, or profitable investment.
You have independently evaluated the risks associated with any cryptocurrency before investing.
You understand that even assets classified as "halal" can lose significant or all of their value.
HalalCrypto bears no liability for any financial losses incurred as a result of using or acting on information from the Platform.

5. API Usage Terms

Access to the HalalCrypto API is available to subscribers of qualifying paid plans. The following terms govern API usage:

Rate Limits: API requests are subject to rate limits specified in your plan documentation. Exceeding rate limits may result in temporary or permanent suspension of API access.
No Redistribution: You may not resell, sublicense, redistribute, or provide third-party access to API data without our express written consent. You may not use API data to build a competing service.
Permitted Use: API data may be used within your own applications, internal tools, or research projects, provided such use complies with these Terms.
Attribution: Where API data is displayed to end users, you must include visible attribution: "Data provided by HalalCrypto (halalcrypto.exchange)".
Data Accuracy: We make no warranty that API data is accurate, complete, or current. You are responsible for validating data before use in any application.
Termination: We reserve the right to suspend or terminate API access at any time for violation of these terms, non-payment, or at our sole discretion with reasonable notice.
Prohibited Uses: You may not use the API to scrape, archive, or mirror our entire dataset, to engage in market manipulation, or for any unlawful purpose.

6. Subscription & Payment Terms

HalalCrypto offers free and paid subscription tiers. Paid features are available through a subscription billed via our payment processor.

Payment Processor: We use Paddle as our Merchant of Record for global payments. By subscribing, you agree to Paddle's terms of service and privacy policy. We do not use Stripe.
Billing Cycle: Subscriptions are billed monthly or annually as selected at checkout. Billing begins on the date of your subscription activation.
Automatic Renewal: Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time through your account settings or by contacting us.
Refunds: We offer a 7-day money-back guarantee for first-time subscriptions. After 7 days, payments are non-refundable unless otherwise required by law.
Price Changes: We reserve the right to change subscription prices with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
Free Tier: The free tier is provided as-is and may be modified, restricted, or discontinued at any time without notice.
Taxes: Prices displayed may or may not include applicable taxes, which vary by jurisdiction. Paddle, as Merchant of Record, handles applicable tax collection.

7. Account Responsibilities

If you create an account on the Platform, you agree to:

Provide accurate, current, and complete information during registration and keep it updated.
Maintain the confidentiality of your account credentials and not share them with third parties.
Accept full responsibility for all activity that occurs under your account.
Notify us immediately at [email protected] if you suspect unauthorized access to your account.
Not create multiple accounts to circumvent restrictions, access limits, or bans.
Not use automated bots, scrapers, or scripts to access the Platform outside of our API offering.
Comply with all applicable local, national, and international laws in your use of the Platform.

We reserve the right to suspend or terminate accounts that violate these responsibilities.

8. Intellectual Property

All intellectual property on the Platform is owned by HalalCrypto or its licensors. This includes, but is not limited to:

Halal Screening Methodology: Our proprietary framework for classifying cryptocurrencies as halal, doubtful, or haram — including the criteria, weightings, and decision logic — is a proprietary trade secret and is protected by copyright and trade secret law.
Algorithms & Software: The trading signal algorithms, market analysis tools, whale detection logic, and scoring systems are proprietary and confidential.
Content: All articles, guides, newsletters, and educational materials are protected by copyright.
Brand: The "HalalCrypto" name, moon logo, and associated branding are trademarks of the Platform operator.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from any Platform content without our express written permission.

Third-party data (e.g., Binance market data, CoinGecko data) remains the property of their respective owners and is subject to their terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, HalalCrypto and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, trading losses, or any other financial losses.

This limitation applies regardless of whether such damages arise from:

Your use of or inability to use the Platform or its data
Any reliance on trading signals, market data, or halal classifications
Unauthorized access to or alteration of your data
Errors, interruptions, or delays in Platform operation
Any other matter relating to the Platform

In any case where liability cannot be fully excluded by law, our total aggregate liability to you for all claims arising out of or relating to these Terms or the Platform shall not exceed the total fees you have paid to HalalCrypto in the 12 months immediately preceding the event giving rise to the claim. If you have paid no fees, our maximum liability is USD $10.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless HalalCrypto, its operator, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

Your use of the Platform or any Platform data
Your violation of these Terms of Service
Your violation of any third-party rights, including intellectual property or privacy rights
Any content you submit, post, or transmit through the Platform
Your violation of any applicable law or regulation

11. Dispute Resolution

Informal Resolution: Before initiating any formal legal proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for a period of at least 30 days.

Binding Arbitration: If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be settled by binding arbitration administered by a mutually agreed arbitration body, conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted on an individual basis only. You waive any right to participate in a class action, class arbitration, or collective proceeding against HalalCrypto.

Governing Law & Courts: These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain, without regard to conflict of law provisions. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the courts of Bahrain, chosen as a leading Islamic finance hub with established legal infrastructure for digital asset disputes.

Limitation Period: Any claim or cause of action arising out of or relating to these Terms must be filed within one (1) year after such claim or cause of action arose, or it will be permanently barred.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes, we will:

Update the "Last Updated" date at the top of this page
Post a notice on the Platform's homepage for at least 14 days
Send an email notification to registered users where reasonably practicable

Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the Platform.

13. Termination Rights

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice, including if we believe you have violated these Terms. Upon termination:

Your right to use the Platform immediately ceases.
Provisions that by their nature should survive termination — including intellectual property rights, disclaimer of warranties, limitation of liability, indemnification, and dispute resolution — shall survive.
For paid subscribers terminated without cause, we will provide a pro-rata refund of prepaid fees for the unused portion of your subscription period.

You may terminate your account at any time by contacting us at [email protected]. Termination does not relieve you of any obligation to pay outstanding fees.

14. Force Majeure

HalalCrypto shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, government actions, pandemics, blockchain network failures, exchange outages, third-party API failures (including Binance API), cyberattacks, power failures, or telecommunications failures.

In the event of a force majeure event, we will make reasonable efforts to resume service as soon as practicable and will communicate material disruptions to our users where possible.

15. Severability & Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

These Terms of Service, together with our Privacy Policy, Risk Disclosure, Cookie Policy, and Shariah Compliance Disclaimer, constitute the entire agreement between you and HalalCrypto regarding the Platform and supersede all prior agreements, representations, or understandings.

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
